DMCA STATEMENT

Digital Millennium Copyright Act (DMCA) Notice & Policy

Lionbranch Real Estate ("Company") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998, as codified in 17 U.S.C. § 512, the Company will respond expeditiously to any claims of copyright infringement committed using the Lionbranch Real Estate website (https://www.lionbranch.com/) that are reported to the Company's Designated Copyright Agent.

If you are a copyright owner, or an agent thereof, and believe that any content hosted on the Lionbranch Real Estate website infringes upon your copyrights, you may submit a notification pursuant to the DMCA by providing our Designated Copyright Agent with the following information in writing (see 17 U.S.C. § 512(c)(3) for further details):

A physical or electronic signature of the person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;

Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;

Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the Company to locate the material;

Information reasonably sufficient to permit the Company to contact you, such as an address, telephone number, and, if available, an email address;

A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and

A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability.

Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification pursuant to the DMCA by providing our Designated Copyright Agent with the following information in writing (see 17 U.S.C. § 512(g)(3) for further details):

Your physical or electronic signature;

Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled;

A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled; and

Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which the Company may be found, and that you will accept service of process from the person who provided notification under Section 512(c)(1)(C) or an agent of such person.

Please be aware that if a counter-notification is submitted, a copy of the counter-notification, including any personal information you provide, will be sent to the person who filed the original DMCA notice. This person may choose to file a lawsuit against you for copyright infringement. If you are unsure about whether the material you posted is infringing, we recommend seeking legal advice before submitting a counter-notification.

Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, the Company has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers. The Company may also, at its sole discretion, limit access to the Lionbranch Real Estate website or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Modifications to DMCA Policy

The Company reserves the right to modify this DMCA policy at any time. Any changes to this policy will be posted on the Lionbranch Real Estate website. By continuing to use the website after any such changes are posted, you are agreeing to those changes. Governing Law and Jurisdiction

This DMCA policy and any disputes related to it will be governed by the laws of the State of Florida, without regard to its conflicts of laws principles. Any legal action or proceeding arising from or related to this DMCA policy shall be brought exclusively in a federal or state court of competent jurisdiction located in Tampa, Florida, and you expressly consent to the personal jurisdiction and venue of such courts.
